Serving the Legal Needs of Your Children
Missouri family law defines “best interest of the child” standards. This includes many different aspects, including recommendations for where the children should live. The GAL will consider the age of the children they are working with.
Factors for determining where a child should be include:
- The parent and child’s current relationship
- The stability for each parent’s living situation
- How easily the parents will be able to cooperate with each other in caring for the child
The Guardian Ad Litem will then report to the court what their investigation details and what they would consider to be a good situation for the child. Contact Clayton Law Firm today to discuss your best available options.
What A Guardian Ad Litem Does
The parents’ attorneys represent the parents and their interests, desires, and demands. They must fight for what their client wants, even if it is not in the best interest of the child. A Guardian Ad Litem is entirely on the child’s side. They can look at the background of the case, the living conditions, and the family relationships the child has with each parent and other relatives. They can interviewanyone, through phone or in person, and then make home visits to assess the child’s situation.
The Guardian Ad Litem can then make a recommendation to the courts on what they think is best for the child in terms of custody, visitation, and/or placement of the child. The parents do not have to accept the recommendation, but the judge will make a final decision.
If the parents in a child custody case are unable to come to an agreement, a Guardian Ad Litem can be a good way to try to find a fair solution. Afamily law attorney can be an ideal Guardian Ad Litem as they understand state laws regarding child custody and visitation, and can ensure their recommendation represents the child’s best interests while remaining in line with state laws.
